5. Nature of the Media Outlet

BXLpositive.news is an independent, citizen-led media outlet with a positive editorial focus on Brussels. To date, it is neither a member of the Council for Journalistic Ethics (CDJ) nor recognised as a press company within the meaning of the law of 7 April 2005. The content is protected under the fundamental right to freedom of expression (Art. 19 of the Constitution, Art. 10 ECHR).

6. Intellectual Property

All original content (text, layouts, visual identity, code, AI-generated illustrations) is protected by Belgian copyright law (Book XI of the Code of Economic Law). Any unauthorised reproduction is prohibited. Quotations from third-party articles comply with the right to quote (Art. XI.190, 1°): short excerpts, source cited, direct link to the original.

7. Visual Credits — Real Photographs vs. AI Illustrations

BXLpositive.news rigorously distinguishes between two types of visuals, in accordance with Article 50 of Regulation (EU) 2024/1689 (the AI Act) on the transparency of synthetic content:

  • 📷 Real photographs — each photograph is labelled “Photograph” followed by the full credit: © Author · Source · Licence (Creative Commons, public domain, direct agreement, etc.). No photograph is published without an identifiable credit.
  • 🤖 AI-generated illustrations — each synthetic visual is labelled “AI-generated illustration”, accompanied by the name of the model used (e.g., google/gemini-2.5-flash-image) and the generation date. These illustrations have no evidential value: they evoke, they do not document. They are never presented as proof of a fact, place, or identifiable person.
  • No deepfakes — no AI visual reproduces the face of a living real person. The illustrations depict stylised, unidentifiable places, atmospheres, or characters.
  • Reporting — any credit error, disputed use, or removal request can be reported to bernardfrisque@hotmail.com. Corrections or removals are made after review, case by case.

The C2PA standard (Content Credentials, cryptographic signing of AI content) is being considered for future integration; in the meantime, the text label beneath each visual serves as confirmation.

8. Applicable Law

This website and any related disputes are governed by Belgian law. The courts of the judicial district of Brussels have sole jurisdiction, without prejudice to mandatory consumer protection regulations.

9. Reporting Content

In accordance with Regulation (EU) 2022/2065 on a Single Market For Digital Services (DSA), you may report any content you consider to be unlawful via bernardfrisque@hotmail.com. Each report is examined and receives a reasoned decision; no maximum deadline is guaranteed at this stage.
